What Is a Foreclosure “Rescue” Scam

If you are facing foreclosure or worried about the security of your upside down mortgage, it’s understandable that you might feel desperate. There are hundreds, thousands of companies and individuals offering to save the day and keep you out of foreclosure or restore your financial security. Don’t let your fear and desperation cause you to make bad choices. Unethical people are seizing on the emotions of people in danger of losing their homes and you do not want to be a victim.

There are several different foreclosure rescue scams to be vigilant against. If a broker or a company promises to keep you out of foreclosure, you should automatically be suspicious. No third party can prevent a bank from foreclosing on your home. What happens to your property is between you and your lender. Only the financial institution that holds your mortgage can decide whether or not to foreclose when you fall behind on your payments or default on your mortgage. Be on the lookout for unrealistic promises. Anyone who pledges to keep you out of foreclosure is probably a scam artist. There are good and ethical organizations that are available to offer you assistance; however they know that the final decision rests with the bank.

Another red flag is when a company asks for money up front. If you are required to pay a large sum of money in order to “save” yourself from foreclosure or keep your home, you better find out what exactly you are paying for. When someone asks for money from you in order to negotiate with your lender, you might want to think about doing those negotiations yourself. Any bank or lender will hesitate to talk to anyone other than their customers. Paying someone else hundreds or thousands of dollars to do what you can do yourself is silly. Plus, there are no guarantees. You might pay someone what they ask and then never hear from them again.

Make sure you do not turn over your title or the deed to your house. If you are having financial problems, a scam might look like someone offering to buy the house from you, and then rent it back. They will explain it as a way to keep you in your house, until you can get back on stable financial footing. However, when you sign over the deed or the title of your home, you no longer have any rights to it at all. There is no guarantee that you will ever get it back, and you can find yourself a lot worse off financially.

Instead of talking to unethical and possibly illegal companies, take charge of your own foreclosure situation. If you are behind on your mortgage, start talking to your lender. There might be options available that you have not explored yet. If you need help, talk to a reputable foreclosure attorney, or get help from a charitable organization that does not ask for anything in return. Protect yourself from becoming a victim of a foreclosure scam. If you think you have been a victim, contact the attorney general in your state immediately.

The Stuart Florida Market Report ZIP Code 34996 for Condos was very strong for March with more than double the number of sales from last month.   Along with the increased sales, inventory has now dropped again for the second consecutive month, after three months of small inventory gains.  Pending activity dropped slightly, but was still strong.

The current absorption rate for the Stuart Florida Market Report ZIP Code 34996 – Condo is 4.4 months.  This market has now shifted to a sellers market for march of 2013.  A balanced market is considered to occur when the absorption rate is 6 months.

The numbers for March 2012 were: 199 active listings, 58 pending sales and 23 closed sales.  Considerably stronger sales activity this year.

March saw improved sales in the Sewalls Point real estate market in Stuart, FL.  Still a fairly large inventory, but also good number of pending sales.

The absorption rate dropped to 11.4 months.  This is a still a buyers market in Sewalls Point, but is showing signs of change.  A 6 month absorption rate is considered a balanced market where neither the seller nor buyer have an advantage.

Comparing the results to March of 2012, the inventory was 61 homes homes on the market, 12 pending sales and there was only 3 closed sales.  Improving numbers for 2013 by a small margin.

Commentary:

The Martin County Florida Condo Market for February 2013 showed some very positive signs.  After disappointing results from much of the fall season, sales numbers for February were up to 66 units.  This is considerably better than last February of 57 and the weak January numbers of 39.  The inventory continues to decline.  Now down to 604 condos (Down 36 from February of 2012).  This is the second month of decreasing inventory after 3 months of increases.  The median sales price dropped to $88,250 for February of 2013 (Was 85,000 in February of 2012).   While the median list price remained unchanged at $179,000.  These numbers are a little misleading as it appears that prices have stabilized in the condo market.  There have been a relatively greater number of lower priced condos sold which is driving the median sales prices down.

The one month absorption rate dipped to 9.15 months from last months 15.6 months, while the three-month average is now at 11.6 months.  Still a challenging market for condo sellers, but there has been a significant improvement in February.  We still need to see a sustained absorption rate below 9 months for a healthy market and down to 6 or 7 months to be considered a balanced one.

 The Definition of Absorption Rate:
Number of months it takes to sell the current inventory at the present rate of sales. Knowing your area’s Absorption Rate, helps to track trends. Understanding the market and where it is headed is part of our job as real estate professionals. Absorption rate is NOT an exact science. Figuring it is based on the premise that one will be looking for a TREND. It is advised to consistently do the numbers each month, to be able to track a trend.

The Stuart Florida Market Report ZIP Code 34996 for Condos showed some increased activity.  And, after 3 months of increased inventory, it stopped this month and went down by 19.  Pending and sold activity were both up for February.  Quite surprising that the inventory dropped with this strong activity.

The current absorption rate for the Stuart Florida Market Report ZIP Code 34996 – Condo is 10 months.  Still indicating a buyers’ market.  A balanced market is considered to occur when the absorption rate is 6 months.

The numbers for February 2012 were: 207 active listings, 43 pending sales and 13 closed sales.  Even with a slightly lower active inventory for 2013, we’re still generating better activity than last year.

February was the second month in a row of slow sales in the Sewalls Point real estate market in Stuart, FL.  But it appears that this may be the end of this trend as pending sales more than doubled to 17 homes and the inventory came back to approximately normal levels after some historically low numbers.

The absorption rate now stands at 27.5 months.  This is a strong buyers market again.  A 6 month absorption rate is considered a balanced market where neither the seller nor buyer have an advantage.

Comparing the results to February of 2012, the inventory was 66 homes homes on the market, 9 pending sales and there was only 3 closed sales.  Similar sales from last year, but much better pending sales, portending increased sales for the next few months.
